• • "Craft Peptides," "Company," "us," "our," and "we" all refer to Craft Peptides, LLC, a Texas limited liability company.
• • "Services" refers to any and all services arising out of and/or relating to Craft Peptides, including the Site, Mobile App, laboratory access, telehealth consultations, AI Chat, and related offerings.
• • "Products" refers to any and all products offered for sale and/or use in connection with our Services.
• • "You," "your," and "User" refers to you, as an individual, plus any entity on whose behalf you are acting.
• • "Lab Results" refers to the results of any blood sample analyses obtained through our Services.
• • "Personal Information" refers to information relating to your health background, medical history, and related data as defined in our Privacy Policy.

CRAFT PEPTIDES DOES NOT OFFER YOU MEDICAL ADVICE, A DIAGNOSIS, MEDICAL TREATMENT, OR ANY FORM OF MEDICAL OPINION, THROUGH OUR SERVICES OR OTHERWISE.

All material, information, data, and content that Craft Peptides provides through our Services, including through AI Chat or AI assessment, is strictly for general information purposes.

Management Services Organization Structure

Craft Peptides, LLC operates as a Management Services Organization ("MSO") that provides administrative, technology, billing, scheduling, and other non-clinical support services to facilitate your access to healthcare. Craft Peptides does not employ physicians or other healthcare providers, does not practice medicine, and does not direct, control, or interfere with the clinical judgment or medical decision-making of any healthcare provider.

The healthcare providers who deliver medical services through the Craft Peptides platform are either (a) independent healthcare professionals who maintain their own medical practices, or (b) employed by or affiliated with physician-owned professional entities that are separate from Craft Peptides.

Craft Peptides does NOT:

• • Practice medicine or provide medical services
• • Employ physicians or other licensed healthcare providers to render medical care
• • Direct, control, or influence the independent medical judgment of any healthcare provider
• • Establish treatment protocols, clinical guidelines, or prescribing practices
• • Make decisions regarding your diagnosis, treatment, or care

• • No Guarantee of Prescription: A consultation does not guarantee that you will receive a prescription. All prescribing decisions are made at the sole discretion of the treating healthcare provider.
• • Provider Discretion: Healthcare providers may decline to prescribe, discontinue, or modify any treatment plan at any time if they determine it is not medically appropriate.
• • Compliance Required: You agree to use any prescribed medications only as directed and to report any adverse effects promptly.

We partner with Rupa Health to facilitate lab ordering and bloodwork logistics. By ordering labs through Craft Peptides, you consent to our sharing of necessary demographic and health information with Rupa Health and affiliated laboratories.

Lab results will be made available through the Craft Peptides portal once processed. We do not control the turnaround time of third-party laboratories.

Exercise Caution: Your Lab Results might not be as hoped or expected, and may contain distressing or life-altering information. Once you review your Lab Results, you are committing yourself to an awareness of such Lab Results.

AI CHAT IS AN AI-BASED TOOL AND IS NOT A REPLACEMENT FOR HUMAN INTERACTION AND ADVICE. CRAFT PEPTIDES DOES NOT GUARANTEE THAT ANY RESPONSES WILL BE HELPFUL OR ACCURATE. GENERATIVE AI TECHNOLOGY IS KNOWN TO HALLUCINATE OR OTHERWISE PROVIDE INCORRECT ANSWERS.

You represent to us that you are not using AI Chat for the purpose of seeking medical attention, care, or advice. AI Chat is intended only as a supplement to your independent confirmation and judgment and consultation with a qualified healthcare provider.

We utilize Clerk for secure user authentication. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

You are allowed to create a single account for yourself, as an individual eighteen (18) years of age or older. You are solely responsible for the security of your password and Account information.

By creating an account, you consent to receive communications from Craft Peptides, including:

• • Transactional Communications: Appointment confirmations, reminders, lab result notifications, and prescription updates via email, SMS, and push notifications.
• • Marketing Communications: Occasional promotional messages about our Services and wellness content.
• • SMS Consent: By providing your mobile phone number, you expressly consent to receive automated text messages. Message and data rates may apply. Opt out by replying "STOP" to any message.

Treat Craft Peptides, our Affiliates, affiliated service providers, and our community members kindly and respectfully. All information you provide must be complete, truthful, and up-to-date.

You shall not use our Services to engage in any violation of law, fraud, misrepresentation, harassment, or abusive conduct. You shall not introduce malicious code or attempt to impair our systems.

All content, features, and functionality of the Services—including text, graphics, logos, images, software, and compilation thereof—are the exclusive property of Craft Peptides or its licensors and are protected by intellectual property laws.

"Craft Peptides," our logo, and all related names, logos, and slogans are trademarks of Craft Peptides. You may not use such marks without our prior written permission.

NEITHER CRAFT PEPTIDES NOR OUR AFFILIATES MAKES ANY WARRANTY OR REPRESENTATION REGARDING THE AVAILABILITY, QUALITY, EFFICACY, OR RESULTS OF ANY THIRD PARTY'S OFFERINGS.

You acknowledge that you have selected each medical provider or laboratory on your own and that Craft Peptides has not referred, arranged, or recommended any medical provider or laboratory to you.

Our secure platform infrastructure is hosted on Amazon Web Services (AWS). We maintain the privacy and security of your Protected Health Information (PHI) in accordance with HIPAA and applicable state laws.

Craft Peptides' Privacy Policy is incorporated by reference into these Terms in its entirety.

You may deactivate your account at any time by contacting us at support@craftpeptides.com. Deactivation does not entitle you to any refunds for services already rendered.

We reserve the right to terminate your use of our Services for any violation of these Terms, fraudulent or abusive activity, non-payment, or conduct harmful to others or our business interests.

THE SERVICES ARE PROVIDED ON AN "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, CRAFT PEPTIDES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Self-Pay Only: Craft Peptides is a direct-pay specialty practice. We do not participate in Medicare, Medicaid, or private insurance plans.

Refund Policy:

• • Lab Orders: Lab fees are non-refundable once submitted to the laboratory.
• • Subscriptions: If you cancel within 48 hours of initial purchase and have not received lab testing services, you may receive a full refund.
• • Consultations: Appointments canceled with less than 24 hours' notice may be subject to a cancellation fee.
• • Products: Prescription items are non-returnable and non-refundable once dispensed or shipped.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT NEITHER CRAFT PEPTIDES NOR OUR AFFILIATES SHALL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, RELIANCE, OR SPECIAL DAMAGES.

THE MAXIMUM AGGREGATE LIABILITY FOR CRAFT PEPTIDES SHALL BE THE GREATER OF (i) $100.00 USD OR (ii) AMOUNTS ACTUALLY PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold Craft Peptides and our Affiliates harmless in connection with any third-party claim arising from your use of our Services, your violation of these Terms, or your violation of any third-party right.

Any Claim arising out of or relating to these Terms will be governed by the laws of the State of Texas, without regard to its conflict of laws principles.

Except as provided in Section 18, all disputes must be litigated in the state or federal courts in Travis County, Austin, Texas.

Agreement to Arbitrate: You agree that any disputes shall be resolved exclusively through final and binding arbitration, rather than a court, except that (i) claims may be asserted in small claims court, and (ii) either party may seek equitable relief for intellectual property infringement.

WAIVER OF JURY TRIAL: YOU AND CRAFT PEPTIDES HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY.

WAIVER OF CLASS ACTION: EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT ON A CLASS, REPRESENTATIVE, OR COLLECTIVE BASIS.

Informal Resolution: Before initiating arbitration, you agree to first contact us at support@craftpeptides.com to attempt informal resolution. If not resolved within 30 days, either party may proceed to arbitration.

30-Day Opt-Out: You may opt out by sending written notice to Craft Peptides, LLC, Attention: Legal Dept., 700 Jessie Street, Austin, TX 78704, or legal@craftpeptides.com, within thirty (30) days of first becoming subject to these Terms.

We reserve the right to change or modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms, sending an email notification, or displaying a prominent notice within the Services.

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

• • Assignment: You may not assign your rights under these Terms. Craft Peptides may freely assign our rights.
• • Force Majeure: Craft Peptides shall not be liable for any failure resulting from factors beyond our reasonable control.
• • Severability: If any provision is found unenforceable, that provision shall be limited or eliminated, and remaining provisions shall remain in effect.
• • Entire Agreement: These Terms, including the Privacy Policy, constitute the entire agreement between you and Craft Peptides regarding the Services.
